Being a Partner in the Customs-Trade Partnership Against Terrorism (CTPAT) Program with U.S. Customs and Border Protection (CBP) provides your company with a competitive edge through benefits like faster border clearances, fewer inspections, and priority treatment. What Can Trigger Suspension?
- Inaction: Failing to respond to CBP inquiries, validation findings, or corrective action requests.
- Security Failures: Breaches involving seal integrity, facility access, or tampering,
- Compliance Lapses: Outdated Security Profile responses, lack of documentation, or failure to submit the Security Profile.
- Business Partner Risk: Utilizing non-compliant partners or failing to monitor them effectively.
- Validation Discrepancies: Repeat findings or providing misleading information during the validation process.
What If a Security Breach Happens?
Security incidents can happen, even in well-managed supply chains. What happens next can determine your company’s future in the CTPAT Program.
1. CBP Review
The CTPAT Program will:
- Request detailed documentation
- Review internal reports of investigation
- Potentially conduct a Post-Incident Analysis (PIA) site visit
2. Temporary Loss of Benefits
While your status remains “Certified” in the Status Verification Interface (SVI), benefits such as FAST lane access may be immediately suspended during the review.
3. Post-Review Outcome
Depending on the findings:
- No action to change a Partner’s benefits or status may be taken
- Partial or full suspension of benefits, to include a change of account status (SVI)
- Removal from the program, with an option to appeal
Will You Be Suspended Immediately after a Security Breach?
Not necessarily. CTPAT does not automatically suspend a Partner after a security breach. Immediate suspensions are handled on a case-by-case basis, considering factors like:
- History of noncompliance or repeat violations
- Incomplete or missing Security Profile submissions
- Previous validation findings
- Partner’s responsiveness, transparency, and corrective actions
Acting quickly and communicating with CTPAT matters. Immediate notification to your Supply Chain Security Specialist (SCSS), a documented corrective action plan, and full internal investigation report can all work in your favor.
What Happens If a Company Fails to Submit a Security Profile?
Failing to submit your CTPAT Security Profile can have serious repercussions on your membership status. If your Profile is not submitted by the deadline:
- The CTPAT Portal will send automatic emails providing updates of the status of your Security Profile.
- Your assigned SCSS should follow up multiple times requesting a response.
- If there is still no submission, your company will receive a final warning — usually with 7 to 14 days to comply.
- If the Profile remains incomplete after that final notice, your company will be suspended from the program.
What’s Really at Stake?
If you are suspended, CTPAT will notify you via email and letter. The suspension letter will explain the reasons for the suspension and will include the requirements necessary to be reinstated in the program. Consequences of the suspension include:
- More inspections, leading to longer delays at ports of entry
- Loss of CTPAT benefits, including FAST and mutual recognition
- Reputational damage with business partners and clients
- Potential removal from the CTPAT Program, putting your competitive edge at risk
